TERMS OF AGREEMENT

By purchasing this online course, you agree to the following terms.


This Online Course Purchase Agreement (the "Agreement") is entered into by and between Elevature Pty Ltd (the "Course Provider"), located at Unit 4/322 Old Cleveland Road, Coorparoo, QLD, 4151, Australia, and You (the "Student"), collectively referred to as the "Parties."

Course Fee

The fee for the course is AUD $1,000.00 + GST, payable in full prior to accessing the course materials. The Course Provider reserves the right to adjust the course fee at any time.

Course Access

The Course Provider will grant the Student access to the course for its duration. However, the Course Provider reserves the right to remove access after 6 months of inactivity. Elevature Pty Ltd also reserves the right to revoke access if the course is purchased for reasons other than the implementation of a single Actionstep instance. Refunds are provided solely at Elevature Pty Ltd’s discretion.

Current Actionstep partners or individuals providing (or intending to provide) implementation services are prohibited from accessing this course. If unauthorized parties are found to be accessing the course, Elevature Pty Ltd values the intellectual property of the course at AUD $350,000, based on average annual revenue from providing implementation services. Legal proceedings will be taken if the course is accessed without authority or used improperly.

Course Content

The Course Provider will provide access to all course materials, including video tutorials and templates. The Course Provider reserves the right to update or change course content at any time but is not obligated to do so. The content is based on methodologies for basic Actionstep configurations, primarily for the Australian market, and may not be applicable in all countries. You understand the risk and agree the Course Provider is not obligated to provide any refund if the course content is deemed not applicable to your region.

By purchasing the course, you acknowledge that you are responsible for the implementation of your Actionstep instance. Elevature Pty Ltd will not be involved in the implementation process and has not obligation to provide any support or training. You are prohibited from modifying, reverse engineering, or distributing any intellectual property created by Elevature Pty Ltd.

Confidentiality

The Parties agree to keep all confidential information shared between them private and not disclose such information to third parties without Elevature's prior written consent.

Refund Policy

Refunds will only be issued in the following circumstances, and at Elevature Pty Ltd’s sole discretion:

1. If the course is canceled by the Course Provider, a full refund will be provided.

2. If the course is canceled due to unauthorized access, no refund will be provided.

3. In cases of extenuating circumstances, a partial refund may be considered.

Intellectual Property

All course materials remain the exclusive property of Elevature Pty Ltd and are protected by copyright and trademark laws. By purchasing the course, you are granted a limited, non-transferable license to access and view the content for personal use only. Unauthorized reproduction, distribution, or modification of the content is prohibited.

Elevature Pty Ltd reserves the right to revoke your access if you violate the terms of this agreement, including unauthorized sharing or downloading of course materials. Legal action will be taken if the Course Provider believe intellectual property has been misused.

Disclaimer

The course content is based on methodologies developed by Elevature Pty Ltd and is intended to assist with the implementation of Actionstep. However, Elevature Pty Ltd makes no guarantees that the course covers all features of the system. Elevature Pty Ltd will not be held liable for any damages, losses, or business interruptions caused by the course content.

The course is not officially affiliated with or endorsed by Actionstep. Elevature Pty Ltd’s total liability is limited to the amount paid for the course.

Disputes and Complaints

Elevature Pty Ltd is committed to resolving disputes amicably. If a dispute arises, the parties agree to work together in good faith before taking legal action. Complaints should be submitted in writing to hello@elevature.com.au. Elevature will respond within 28 days.

If the dispute cannot be resolved within 60 days, either party may initiate a formal claim. All claims must be made in QCAT Small Claims Court. Elevature Pty Ltd reserves the right to pursue legal action outside of small claims court if necessary.

Governing Law

This Agreement is governed by the laws of Queensland, and any legal claims made against Elevature Pty Ltd will be settled in QCAT Small Claims Court. Only Elevature Pty Ltd reserve the right to initiate legal proceedings outside QCAT Small Claims Court, in relation to the misuse of Course Material, Intellectual Property, or unauthorized access. The parties agree to submit all disputes to the exclusive jurisdiction of these courts.
