PRIVACY POLICY

By purchasing this online course, you agree to the following terms of agreement.


This Online Course Purchase Agreement (the "Agreement") is entered into between Elevature Pty Ltd (the "Course Provider"), located at Unit 4/322 Old Cleveland Road, Coorparoo, QLD, 4151, Australia, and You (the "Student"), collectively referred to as the "Parties."

Course Fee

The fee for the Course is AUD $1,000.00 + GST, payable in full before access to the course material is granted. The Course Provider reserves the right to change the Course Fee at any time.

Course Access

The Course Provider will grant the Student access to the Course for its duration. The Course Provider reserves the right to revoke access after 6 months of inactivity. Elevature Pty Ltd may revoke access at any time if the Course is purchased for reasons other than implementing a single Actionstep instance. Refunds are at the sole discretion of Elevature Pty Ltd. Elevature reserves the right to assess and accept or deny enrollments at its discretion, without prejudice. Current Actionstep partners or those providing or intending to provide implementation services are prohibited from accessing this course and its content. Elevature Pty Ltd reserves the right to deny or revoke access if unauthorized parties are believed to have access.

In cases where the course is believed to have been used to train parties intending to implement Actionstep, Elevature Pty Ltd values the intellectual property of the Course content at AUD $350,000. If Elevature believes the Course has been purchased for improper purposes, Elevature reserves the right to pursue legal action, including injunctive relief and damages.

Course Content

The Course Provider will give the Student access to course materials, including video tutorials and templates. The Course Provider reserves the right to modify course content at any time. By entering this agreement, you acknowledge that the course content is based on methodologies developed by Elevature for basic Actionstep implementation.

You understand that course content, particularly regarding templates and data imports, may not always be up to date. Course content is created primarily for the Australian market, but can be used elsewhere. You are solely responsible for implementing your Actionstep instance, and Elevature Pty Ltd is not liable for assisting in this process.

You may not modify, adapt, reverse engineer, or distribute Elevature’s intellectual property. Any unauthorized access to the content will result in immediate legal action.

Confidentiality

The Parties agree to keep all confidential information disclosed by the other Party confidential and not disclose such information without prior written consent from Elevature Pty Ltd.

Refund Policy

Refunds will be provided at the sole discretion of Elevature Pty Ltd in the following circumstances:

1. The Course is canceled by the Course Provider, in which case a full refund will be provided. If the cancellation is due to unauthorized access, no refund will be provided.

2. The Student is unable to complete the Course due to extenuating circumstances, in which case a partial refund may be provided at the Course Provider's discretion.

Intellectual Property

All course material remains the exclusive property of Elevature Pty Ltd and is protected by copyright and trademark laws. By purchasing the course, Elevature grants the Student a limited, non-exclusive, non-transferable license to access and view the content for personal use. Unauthorized reproduction or distribution of the content is strictly prohibited, and any breach will lead to legal action.

Disclaimer

You understand that the course content is based on methodologies developed by Elevature Pty Ltd for Actionstep implementations. Elevature makes no guarantees that the course covers all features or configuration options for Actionstep. The course content has been created by Elevature Pty Ltd and is not affiliated with or approved by Actionstep.

You agree that Elevature Pty Ltd is not liable for any indirect, incidental, punitive, or consequential damages. In the event of a claim, the total liability is limited to the amount paid for the course.

Disputes and Complaints

Elevature Pty Ltd aims to resolve disputes without formal legal proceedings. You agree to first attempt to resolve any disputes informally via written communication. If unresolved within 60 days, either party may initiate a formal claim. Disputes will be handled in QCAT small claims court, and both parties waive the right to pursue class actions.

Governing Law

This Agreement is governed by the laws of Queensland. The QCAT Small Claims Court will have exclusive jurisdiction over disputes relating to this Agreement, and both parties submit to its jurisdiction.
